Q: How is it about photos used by organisations taken by a professional photographer, previously not under an open licence and we would now like to publish them under an open licence?
A: Photos from photographers used on an organisation's website, often there is an agreement between photographer and the institution. This needs to be carefully checked, if nothing is said about publishing under open licence or it is not clear, it needs to be clarified with the rights holder, if the photo can be used for the intended purpose and also be published under an open licence
There is a consequence, if I publish this photo under an open licence, then the rights holder needs to be aware of the implications of reuse and distribution by other users. If you get the permission, ask for it in writing, so you have it at hand, if it is disputed or questioned later.
It might be impossible to get the permission to publish it under an open licence, then there is the possibility to exchange the photo with a photo that has an open licence.
